Heard learned counsel for the petitioners and the learned AGA appearing for the State respondents.
The petitioners through the present petition have invoked the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India prying for certiorari quashing the impugned F.I.R. dated 16.06.2010 relating to Case Crime No.291 of 2010 Under Sections 498-A, 323, 504, 506, I.P.C. and Section 3/4 of Dowry Prohibition Act, Police Station Gal Shaheed District Moradabad. The ancillary prayer is to issue a writ of mandamus commanding the respondents not to arrest the petitioners in the aforesaid crime number pendentilite the writ petition.
A perusal of the impugned FIR discloses commission of cognizable offence Hence the question of quashing the F.I.R. does not arise. The writ petition in this regard is dismissed with a direction to the Court concerned that the bail prayer of the petitioner No.1 Ziyaul will be considered and disposed of expeditiously, if possible on the same day. It is further provided that in the facts of this case till the submission of the charge sheet petitioner Nos. 2 to 7 namely Mohd Shareef, Raisha, Shabana , Km. Munni, Saleem and Reshama shall not be arrested in the aforesaid case.
