Heard learned counsel for the petitioner(s) and learned A.G.A. for the State.
The challenge herein is to a First Information Report dated 28.04.2021 bearing Case Crime No. 159 of 2021 alleging commission of an offence by the petitioners under Sections 147, 148, 307, 323, 504, 506 I.P.C., Police Station- Mohammadpur Khala, District- Barabanki.
On a perusal of the First Information Report impugned herein it can not be said at this stage that no cognizable offence is made out against the petitioner(s), therefore, leaving the factual issues open for investigation we are not inclined to interfere in the matter.
The fact that there are cross F.I.R. does not make any difference to the merits of the case, as, no ground is made out for quashing the F.I.R.
Accordingly, we dismiss the writ petition but without prejudice to the rights of the petitioners to avail other remedies such as under Section 438/439 I.P.C. etc. Order Date :- 19.5.2021 R.K.P.
