Heard Sri Mohd. Ayub, learned counsel for the petitioner and Sri B.P. Singh Kachhawah, learned Standing Counsel for the State.
Though, challenge has been raised to the recovery certificate dated 1.2.2021 and the consequential recovery citation dated 20.6.2021 seeking recoveries of Rs.120396/- from the petitioner towards road tax etc. on his registered vehicle bearing Truck No.U.P.-83- K-9215, in paragraph 16 of the writ petition, it has been stated that the petitioner is willing to deposit the said amount.
Learned counsel for the petitioner states that the petitioner is entitled to rebate being granted by the State Government, in view of the spread of pandemic COVID-19.
In view of the above, it is provided, in the event, the petitioner deposits the entire disputed amount of tax within a period of two months from today, he may remain entitled to the benefit, if any, granted by the State Government on account of spread of the pandemic COVID-19.
For the period of two months, no coercive measures be adopted against the petitioner, pursuant to the recovery certificated dated 1.2.2021 issued by the respondent no.3.
It is further provided, in case the petitioner fails to deposit the entire disputed amount of tax, the recovery proceedings shall revive from that stage.
With the above observation, the writ petition is
disposed of.
