It is stated that the petitioner was engaged on the post of Protection Watcher in the Forest Department of the State of U.P. in September, 2000 and he continued to work uninterruptedly. Grievance is that when petitioner raised the claim for regularisation, the respondents have unauthorisedly stopped the petitioner from signing on the attendance register, and he has not been paid salary either since April, 2016. Submission is that the petitioner's claim for regularisation is covered by the Rules of 2016 but the respondents have not examined the matter.
Learned Standing Counsel submits that the claim of the petitioner shall be examined by the authority concerned, in accordance with law.
Considering the above, this petition stands disposed of with a direction upon the respondent no. 4 to accord consideration to petitioner's claim for regularisation, in accordance with the rules of 2016, by way of speaking order within a period of four months from the date of presentation of certified copy of this order. In case petitioner has been working for more than 10 years, the respondents shall also consider the petitioner's claim for being paid minimum of salary, except the allowances, keeping the law laid down by Apex Court in State of Punjab and other Vs. Jagjit Singh and others ( 2017)1 SCC 148.
