JUDGMENT / ORDER

Disputes have arisen pursuant to Film Assignment Agreement dated 15.06.2012 that are sought to be resolved by reference to Arbitration in terms of Clause 11.2 of the aforesaid agreement.
2. Notice sent privately, was returned with the endorsement 'left'. Thereafter, substituted notice by way of paper publication was effected. Despite the aforesaid, which constitutes sufficient service, none appears on behalf of the respondent.
3. A perusal of the documents filed establishes that the agreement between the parties contain a clause for resolution of disputes by Arbitration. In the aforesaid circumstances, I am inclined to order this petition.
4. Learned counsel for the petitioner would suggest that Mr.R.Sankaranarayanan, Advocate, be appointed as the Sole Arbitrator in the matter.
5. I, thus, appoint Mr.R.Sankaranarayanan, Advocate, having office at 'Shreyas' No.26, Dr.R.K.Salai 9th Street, Mylapore, Chennai - 600 004 (Phone No.28474701/02), as the Sole Arbitrator to enter upon reference and adjudicate the disputes inter se the parties. He may, after issuing notice to the parties and upon hearing them, pass an award as expeditiously as possible, preferably within a period of six months from the date of receipt of this order. The learned Arbitrator is at liberty to fix his remuneration and other incidental expenses, which shall be borne by both the parties equally. The proceedings may be conducted under the aegis of the Madras High Court Arbitration Centre in accordance with the Madras High Court Arbitration Rules.
6. The Original Petition is, accordingly, allowed, leaving the parties to bear their own costs.
