This application under Section 482 Cr.P.C. has been filed challenging charge sheet dated 26.12.2017 submitted in Case Crime No.44 of 2017, under Section 3/4 D.P. Act, P.S. Mahila Thana, District J.P. Nagar, Cognizance Order dated 18.4.2018 passed by Civil Judge (J.D.), District Amroha upon aforesaid charge sheet as well as entire proceedings of Consequential Case No.2207 of 2018 bearing C.N.R. No.U.P.J.B.05003808-
2018 (State Vs. Zameer Shah & others), arising out of Case Crime No.44 of 2017, under Section 3/4 D.P. Act, P.S. Mahila Thana, District J.P. Nagar, pending before Civil Judge (J.D.), District Amroha.
At the very outset, learned AGA has raised preliminary objection by submitting that non-bailable warrant has been issued against applicant on 14.9.2020. Inspite of the fact that a period of more than 10 months has rolled by from the date of order dated 14.9.2020, applicants have not yet appeared before court. Consequently, proceedings of above mentioned case have remained held up on account of non-cooperation of applicants. As such, present applicants do not deserve any indulgence of this court.
When confronted with aforesaid, learned counsel for applicants could not overcome same.
In view of above, no occasion arises before this Court to interfere in present application.
Accordingly, present application fails and is hereby dismissed.
