Criminal Misc. Bail Application No. 1 of 2018 Heard learned counsel for the applicant and learned A.G.A. for the State.
The present criminal revision has been filed to quash the order dated 16.02.2018 passed by the learned Addl. Session Judge/F.T.C. (1st), Amroha in Criminal Appeal No. 34 of 2014 (Zahid and Others Vs. State of U.P.), arising out of Case Crime No. 699 of 2004, under Section- 3/5A/8 of Cow Slaughter Act and Section 3/11 Animal Cruelty Act, Police Station- Rajabpur, District- Amroha and order dated 21.05.2014 passed by the IInd Addl. Civil Judge (Jr. Div.)/Judicial Magistrate, Amroha (State Vs. Zahid and Others) in Session Trial No. 1889 of 2010, arising out of Case Crime No. 699 of 2004, under Section- 3/5A/8 of Cow Slaughter Act and Section 3/11 Animal Cruelty Act, Police Station- Rajabpur, District- Amroha.
Learned counsel for the applicant submits that the applicant has been wrongly convicted inasmuch as neither any recovery was made from the applicant nor he was found to have engaged in cow slaughter. It is thus stated that the conviction has arisen on inconsistent and incomplete testimony as to the complicity of the applicant in the offence as alleged. In this regard, it has been submitted that the applicant had been confined in jail from five and half months and there is no chance of early disposal of the present criminal revision.
Admit.
Summon the lower Court record, returnable at an early date. List for hearing after two months.
Considering the facts and circumstances of the case, let the applicant Zahid be released on bail on furnishing his personal bond and two local sureties each in the like amount to the satisfaction of the Court concerned below in the aforesaid cases.
As soon as personal and surety bonds are furnished, photocopies of the same are directed to be transmitted to this Court forthwith by the concerned court to be kept on record.
