List revised. No one appears on behalf of the respondent nos. 6 and 7.
Heard Shri Yogesh Agarwal, learned counsel for the petitioner.
Despite stop order dated 25.1.2018 no counter affidavit has been filed by respondent nos.6 and 7.
The only prayer of the petitioner is that he may be paid interest on the post retrial dues which were unjustifiably withheld from 30.9.2011 till 20.11.2017. The prayer for payment of actual cost of litigation has also been paid to him.
Learned counsel for the petitioner states that he has filed two writ petitions and two contempt petitions for getting post retiral dues and interest on delayed payment of such dues and therefore he has incurred Rs. two lacs.
In the absence of any counter affidavit on behalf of the respondent nos. 6 and 7, the averments in the writ petition are accepted to be correct . Respondent nos. 6 and 7 are directed to make payment of 7 % simple interest on the post retiral dues to the petitioner from the date they fell due to the actual date of payment and cost of Rs. 80,000/- for prosecuting four litigations before this court within six weeks from the date of production of certified copy of this order before respondent no.7.
The writ petition is allowed. Costs as above.
