Zaheer Haider S/O Late Mohd. ... vs State Of U.P. Thru Secy. Home & Ors.

High Court Of Judicature at Allahabad|29 January, 2010

JUDGMENT / ORDER

Hon'ble Yogendra Kumar Sangal,J.
Heard the learned counsel for the petitioners, learned A.G.A. and perused the material on record including the F.I.R. in question.
The F.I.R. discloses commission of cognizable offence. Therefore it cannot be quashed.
Learned counsel for the petitioners, however, submits that the offences are triable by Magistrate and not so grave. It is also submitted that there are cross cases/versions and at this stage it cannot be ascertained as to who was on the wrong footing.
Learned A.G.A. has nothing to say substantial against it.
In view of the aforesaid facts and circumstances, as an interim measure it is provided that till any credible and cogent evidence is collected against the petitioners, they (Zaheer Haider, Asif, Arif, Azaz Husain alias Sonu and Kamar Raza) shall not be arrested in Case Crime No. 8-A of 2010, under Sections 452, 392, 504, 506 I.P.C., Police Station Kotwali Chowk, District Lucknow subject to their full cooperation in the investigation which shall go on.
With these observations this petition is finally disposed of.
