At present, the private respondent is claimed to be in possession on the basis of revenue entries standing in his favour. The case of the petitioner is that the respondent has encroached upon public pond.
In such facts, it is difficult to issue a mandamus to decide the representation seeking removal of encroachment as that would necessarily involve proceedings for correction or amendment of the revenue entires.
