Heard learned counsel for the applicant.
A writ petition preferred by the applicant was disposed of by the writ Court on 13 October 2017 directing the Senior Superintendent of Police, Kaushambi to look into the matter, ensure that a fair and expeditious investigation is carried out and completed speedily without any undue delay. This Court notes that the FIR itself had been registered in 2017 and that the only allegation in support of this contempt petition is that investigation has not been concluded nor has any action been taken against the accused persons. In the absence of any further material or allegation, this Court presently at this stage is unable to hold that there has been an inordinate delay in complying with the order of the writ Court especially as no stipulated time-frame stood mentioned in the said order.
In view of the above, this Court refuses to draw proceedings at this stage. However, it is clarified and directed that the Superintendent of Police, Kaushambi shall ensure that the investigation in Case Crime No.183 of 2017 is completed with expedition and bearing in mind the letter and spirit of the order of the writ Court dated 13 October 2017.
The petition is disposed of.
