Heard learned counsel for the applicant and learned A.G.A.
This application has been filed with a prayer to quash the order dated 23.5.2008 passed by learned Special Judge (P.C. Act) Lucknow in criminal case No. 25 of 2008 under section 7/13 (D) read with 13(2) Prevention of Corruption Act, 1988.
From the perusal of the record it appears that it is not a proper stage to express any opinion on the merits of the case because it may affect the mind of the court concerned, therefore, without expressing any opinion on the merits of the case, it is directed that in case applicant moves discharge application or raises the objection at the time of framing of the charge, the same shall be heard and disposed of in accordance with law.
With this direction, this application is finally disposed of.
