Heard Sri Shiv Sagar Singh, learned counsel for the petitioner and Sri Hari Mardan Singh, learned Additional Chief Standing Counsel for the State-respondents.
This writ petition under Article 226 of the Constitution of India, has been filed by the petitioner claiming himself to be tenant of respondent No.5, praying for the following relief:
"a. Issue a writ, order or direction in the nature of mandamus commanding the respondent No.2 to protect the right of the petitioner as provided under the UP Rent Control Act, 1972 and further not to dispossess or remove from petitioner from legal possession without authority of law."
I do not find any good reason to entertain the present writ petition leaving it open to the petitioner to avail such remedy as may be available to him under law, before the appropriate forum.
With these observations, the writ petition is dismissed.
It is made clear that this court has not expressed any opinion on merits of the case of the petitioner.
