JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI)
1. Some of the convicts are in habit of applying for temporary bail for every small matter and the jail remarks shows that they remain more outside rather inside the jail. Present is one such case.
2. In the present case, the convict has enjoyed as many as seven temporary bail and two furlough's and one parole within last three years. He enjoyed two temporary bail in the year 2010, then he enjoyed two temporary bail in the year 2011 and in the same year he enjoyed second, third and fourth furlough in the month of January, 2011 to March, 2011 and fifth furlough in the month of October-November, 2011. Thereafter, he enjoyed parole also in the month of November-December, 2011. Last in the year 2012, he has enjoyed as many as three temporary bail and the last he was out in the month of May-June, 2012, on account of illness of his son.
3. The present application is filed by the convict through his wife praying for temporary bail for the purpose of agricultural operations.
4. Taking into consideration the aforesaid background, this Court is of the opinion that no case is made out to grant the temporary bail and hence the same is rejected.
