THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 15330 of 2014 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) Though the matter could have been sent back to the appropriate Bench, the same has been placed before this Bench, after placing the matter before the Hon’ble The Chief Justice on administrative side.
The allegation made in the writ petition is with regard to the alleged encroachment of the Government land in question.
We are of the view that the petitioner can very well approach under Section 8 of the A.P. Land Grabbing (Prohibition) Act, 1982, which empowers the Special Court to take steps at the first instance in the event any complaint is made against others by any person. If the petitioner makes such approach in accordance with law, the Special Court shall look into the matter.
Subject to the above observation, the writ petition is disposed of.
Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
