(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Registry was directed to place the papers of grating temporary bail in the month of November, 2011. Accordingly, the Registry has made available for perusal the papers of Criminal Misc. Application No.15960 of 2011 in Criminal Appeal No.271 of 2009. Besides the Registry was also directed to keep the papers of appeal along with this matter. The papers of appeal are also made available for perusal.
On perusal of the papers, it is noticed that the Court granted temporary bail for a period of 10 days by order dated 23.11.2011 on strict condition in the peculiar facts and circumstances, prevailing at the relevant time. So far as the present ground is concerned i.e. about ill health, the learned APP made available for perusal Certificate dated 11.6.2012 given by Dr.C.R.Makwana, Medical Officer, Central Jail Dispensary, Ahmedabad; wherein, it is stated that "He is suffering from low mood, lack of interest, headache, occasional suspiciousness and sleep disturbance. For his complaints, he is reguarly followed up at Psychiatry Department, Civil Hospital, Ahmedabad for examination and treatment.
Lastly, he visited Psychiatry Department, Civil Hospital, Ahmedabad on 2.6.2012 and was examined by Dr.G.K.Vankar (Head of the Department) and treated accordingly for 30 days and recalled on 3.7.2012 for follow up.
He is regularly provided the medicines under the supervision of jail doctors........"
In view of that this Court is of the opinion that no case is made out for grant of temporary bail.
Hence, this application is rejected.
