Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the post death rituals of his aunty who has died on 10th March, 2012.
Along with the application, the death certificate is annexed. Therefore, ground appears to be genuine.
From jail remarks, we find that the the applicant is sentenced to 4 years R.I. of which, he has already undergone more than 1 year and 8 months sentence by this time. Further, earlier he was enlarged on furlough leave and he has surrendered to the jail authority in time.
Considering the totality of the facts, it is ordered that applicant-convict shall be enlarged on temporary bail for a period of 10 days from the date of his actual release on personal bond of Rs.5,000/- with one surety of like amount and with the further direction that he shall surrender to the jail authority on expiry of the period granted by this Court.
Application allowed to the aforesaid. Rule made absolute.
