Heard learned counsel for the applicant and learned A.G.A. perused the record.
Counsel for the applicant has been fair enough to admit that the statutory remedy of seeking the recall of ex-parte order has not been availed, therefore he wants to withdraw this application.
In view of aforesaid submission made by the counsel for the applicant, this application stands dismissed as withdrawn with liberty to adopt the statutory remedy which may be available to the applicant under the law.
