Petitioner is the first accused in Crime No.557 of 2014 of the Valiyathura Police Station for the offences punishable under Secs.379, 406 and 420 r/w Sec.34 of the Indian Penal Code, apprehends arrest and has preferred this application.
2. Learned Public Prosecutor has opposed the application.
It is submitted that the petitioner is a Contractor of the IOC and registered owner of the vehicle involved. That vehicle was to carry aviation turbine fuel in calibrated tank. Fuel was drained out from the tank making alteration in the tank.
3. Learned counsel submits that the allegations are not true. It is submitted that the petitioner had entrusted his vehicle to his workers. He is falsely implicated only for the reason that he is the registered owner of the vehicle. It is also submitted that the petitioner is undergoing treatment for serious illness. Some documents are also produced supporting that.
4. Petitioner has to be interrogated since admittedly he is owner of the vehicle from which fuel was allegedly stolen. Pre-arrest bail would affect investigation. In the circumstance, request for pre-
B.A.No.3859 of 2014 2 arrest bail cannot be allowed. But it is directed that in case the petitioner is arrested, after interrogation is over, he shall be produced before the jurisdictional magistrate as early as possible.
The application is disposed of as above.
