Heard learned counsel for the applicant as well as the learned A.G.A. for the State and perused the material on record.
The instant bail application has been filed on behalf of the applicant- Yogeshraj, relating to Case Crime No. 583 of 2018, under Sections 147, 148, 149, 332, 333, 353, 341, 336, 307, 427, 436, 109 I.P.C., Section 7 of the Criminal Law Amendment Act, 1932 and Section 3/4 of Prevention of Damage of Public Property Act, 1984, Police Station Syana, District Bulandshahr, during pendency of trial.
Learned counsel for the applicant has contended that the co- accused, Devendra Singh, has been granted bail by this Court on 5.8.2019 in Criminal Misc. Bail Application No. 31468 of 2019. The case of the applicant stands on identical footing, hence the applicant is also entitled for bail on the ground of parity. The applicant does not have any criminal history to his credit. In case, the applicant is released on bail, he will not misuse the liberty of bail.
Learned AGA has opposed the prayer for bail, but does not dispute the claim of parity.
Let the applicant involved in aforesaid case be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:-
(i) The applicant shall not indulge in any criminal activity.
(ii) The applicant shall not tamper with the prosecution evidence.
(iii) The applicant shall not pressurize the prosecution witnesses.
(iv) The applicant shall regularly appear on the dates fixed by the trial court unless their personal attendance is exempted by the trial court.
In case of default of any of the conditions enumerated above, it will be open to the opposite parties to approach the Court for cancellation of bail.
