1. The party-in-person submitted that her husband Yogendrabhai is in custody in connection with two cases, namely, Kagdapith Police Station C.R.No. 5284 of 2009 as well as Kagdapith Police Station C.R.No. 161 of 2009 and the instant applications are filed for accused Yogendrabhai on the ground that the two minor children of the applicant-accused and of the party-in-person are required to be admitted in the school.
2. I have considered submissions advanced by Mr. Pandya, learned APP for the respondent-State.
3. It transpires that in the instant matters, the accused Yogendrabhai is in jail since last three years. It is further submitted that some of the co-accused persons in both the cases came to be released on temporary bail even on the identical ground.
4. In above view of the matter, both the applications are partly allowed.
5. The applicant-accused Yogendrabhai @ Dadu Kishorsinh Sisodiya is ordered to be released on temporary bail for the period of two weeks from the date of his actual release on his furnishing personal bond of Rs. 10,000/- (Rupees Ten Thousand only) with one surety of the like amount to the satisfaction of the concerned jail authority on the condition that during his temporary absence, he shall not misuse the liberty and upon completion of the temporary bail period, he shall immediately surrender to the concerned jail.
6. Rule is partly made absolute. Direct service is permitted.
