It is the case of the petitioner that a lease of land in dispute was granted in the name of his mother. After the death of his mother, the petitioner claims to be in possession on the strength of the same lease-deed.
It is the case of the petitioner that proceedings under section 198(4) of the U.P. ZA & LR Act were drawn, but the same were dismissed in the year 1991, which order has become final between the parties.
Subsequently, in the year 2012, fresh proceedings under section 198(4) of the said Act have been initiated, which are barred in view of the earlier order passed in the year 1991.
Learned Standing Counsel prays for time to obtain instructions in the matter.
In view of the aforesaid, put up as fresh on 24.2.2014.
