Heard learned counsel for the petitioner and Piyush Shukla, the learned Standing Counsel.
The petitioner worked under the respondents as a Tubewell Operator. He retired from service on 31 March 2019. It appears that he came to be arraigned as an accused in Case Crime No.941 of 2013 which ultimately ended in his conviction. That judgment of conviction was assailed in Criminal Appeal No.7858 of 2019. The aforesaid appeal was allowed on 13 July 2019 and the petitioner and other accused acquitted. According to learned counsel, although the aforesaid proceedings have come to an end in favour of the petitioner, his retiral benefits have not been released till date.
Learned Standing Counsel appearing for the third respondent states that subject to verification of the aforesaid facts and contentions on merits being kept open, the claim of the petitioner for release of retiral benefits, shall be duly examined and a final decision in respect thereof communicated with expedition and in any case within a period of four months from the date of presentation of a duly authenticated copy of this order.
Accordingly, this petition shall stand disposed of in light of the statement noted above.
