This revision has been filed against the judgement and order dated 3.5.1989 passed by learned III Addl. Sessions Judge, Agra in Criminal Revision No. 93 of 1989 setting aside the summoning order passed by Munsif Magistrate, L.C.C.-II, Agra on 6.2.1989 in Complaint Case No. 819 of 1988 Yogendra Singh Vs. Satish & other, under sections 147, 148, 149, 307 IPC, P.S. Achhnera, District Agra.
From a perusal of the impugned order passed by learned IIIrd Addl. Sessions Judge, Agra it appears that the same has been passed in a just and legal manner and there is neither any perversity nor illegality. so as to warrant interference in exercise of revisional jurisdiction. Moreso, the revisionist is also not present to press this revision.
Accordingly, this revision is dismissed both on merit as well as for want of prosecution.
However, in case the cause of action still survives, the revisionist is at liberty to approach the Court by filing the recall application or any other remedy available under the law and procedure.
