This appeal was filed by Yogendra Pal son of Ram Swarup against the judgment and order dated 07.04.1993 passed by Special Judge, Fatehpur in S.T. No.48 of 1986.
On 31.07.2019, as no one had appeared on behalf of the appellant to press the appeal, following order was passed:-
"The case has been called out. No one has appeared on behalf of the appellant to press the appeal.
This appeal was admitted on 04.05.1993 and the appellant was released on bail on furnishing personal bond and two sureties of the like amount to the satisfaction of Special Judge, Fatehpur.
As already sufficient time has passed since the admission of the appeal and no one has appeared on behalf of the appellant, we deem it appropriate to issue bailable warrants to the appellant, fixing 28th August, 2019.
List on 28th August, 2019.
In case the Chief Judicial Magistrate concerned finds that the appellant is no more alive, he shall submit report accordingly, after conducting inquiry, as per the circular of this Court. In case the lower court record has not been called as yet, the same shall be summoned forthwith."
Pursuant to the above order, the Chief Judicial Magistrate, Fatehpur has submitted a report dated 21.08.2019, which is accompanied with documents as well as the statement of witnesses. The report indicates that the sole appellant Yogendra Pal died about 8 years back.
In view of the above, the appeal stands abated.
