Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.
Present writ petition has been filed seeking quashing of the impugned order dated 14.6.2021 passed by the respondent no. 2 having Patrank No. 1865/S.T./2021 in relation to Araji No. 283 Village/Mauja Jivanpura, Post Sadalpura, Pargana Dhoos, Tehsil Pandit Deen Dayal Upadhyay Nagar, district Chandauli.
By this order the respondent no. 3 has asked the Tehsildar to submit his report regarding alleged construction. It appears that a report dated 12.6.2021 has already been filed. There appears to be no substantive order.
Learned Standing Counsel submitted that the powers are being prima-facie exercised under Section 134 of the U.P. Revenue Code, 2006.
It appears that no final orders have been passed.
In such view of the matter, I am not inclined to entertain the present writ petition particularly when the petitioner can avail the remedy as may be available to him in accordance with law under the aforesaid Revenue Code.
This writ petition is, accordingly, dismissed. No order as to costs.
