Heard learned counsel for the petitioner and Sri Kailash Prakash Pathak, Additional Solicitor General of India for respondents no.1 to 4.
The petitioner pursuant to advertisement published by respondents has applied for the post of Soldier Tradesmen (All Arms). The petitioner was issued admit card and he appeared on 08.10.2018 for participating in physical test at prescribed place, however, the candidature of petitioner has been rejected by order dated 08.10.2018 on the ground that the petitioner has applied from several places whereas as per advertisement, candidate shall submit application from one place. Against the said order, the petitioner preferred representation which was also rejected by order dated 05.03.2019. The petitioner has approached this Court after about 871 days from the date of rejection of his candidature. It means that he has approached after about more than two years.
There is no pleading in the writ petition that selection for recruitment advertised in October, 2018 has not yet been completed.
Since, there is no explanation of delay of about 871 days and the selection process has been completed, this Court finds that the writ petition is barred by delay and laches.
For the reasons given above, the writ petition lacks merit and is dismissed.
