The writ petition has been filed against the notice issued by City Magistrate dated 5.2.2018 seeking upon the petitioner to move a fresh application according to Arms Rules, 2016.
Since Rule 25 of Arms Rules, 2016 requires fresh application in the format as given under Arms Rules 2016 as such notice issued by the City Magistrate does not suffer from any illegality.
In the facts of the case, the writ petition is disposed of with the observation that in case fresh application is moved by the petitioner within two weeks from today along with certified copy of this order then same would be considered and decided by the competent authority in accordance with law in the light of previous police report within a period of two months thereafter.
