Heard learned counsel for the applicants, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with the prayer to quash the Charge Sheet No. 24/10 dated 30.7.2010, cognizance order dated 1.9.2010, bailable warrant dated 9.7.2019 as well as further proceedings of Special Trial No. 2458 of 2017 (State vs. Yogendra Giri) arising out of Case Crime No. 248 of 2010, under Sections 323, 504, 506 IPC and 3(1) X of SC/ST Act, P.S. Sikariganj, District- Gorakhpur, pending in the court of Special Judge, SC/ST Act, Gorakhpur.
As per the allegations made in the first information report, it is alleged that incident had taken place in the year 2010 and the charge sheet has been submitted on 30.7.2010 and the applicant has been summoned to face trial vide order dated 1.9.2010.
After the delay of more than 9 years, the present application has been filed, However, latches in filing the present application has not been explained at all.
In view of above, the application u/s 482 Cr.P.C. is wholly misconceived and is accordingly dismissed.
