Yogendra Bhardwaj And Another vs State Of U.P. Thru Secy. And 3 ...

High Court Of Judicature at Allahabad|14 July, 2016

JUDGMENT / ORDER

The case is taken up in the revised list.
Learned counsel for the petitioner is present.
Short counter affidavit has been filed by the State, which is taken on record.
From the affidavit it can very well be inferred that every effort was being made to trace out the corpus, but in vain.
Learned counsel for the petitioner is also failed to give any detail regarding the corpus and only it is shown that corpus is in illegal detention of any person, nobody can be opposed under the jurisdiction of writ. If any person is missing, an information in this regard has already been given to the police department and the police department should take their efforts to trace out the corpus. This Court is of the view that no further order is required by this Court in the matter. In case proper investigation is not being made then remedy lies elsewhere, and petitioners can very well to move the higher authority.
Learned counsel for the petitioners agreed that further proceeding in this case is futile.
Accordingly, this writ petition is disposed off.
Order Date : - 14.07.2016.
