JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) 1.0 The appellant, working as Unarmed Head Constable under the respondent had approached this Court under Article 226 of the Constitution for the relief of rechecking and reassessment of the answer-sheets submitted in the examination held on 5th & 6th September 2009, for promotion to the post of Police Sub-Inspector. As described in detail in the impugned order, a Special Committee of three high ranking officers of the department was constituted and that Committee had already reassessed and reexamined the answer-sheets of the appellant. Therefore, the prayers of the appellant could not be granted, inspite of the unfortunate fact that the appellant was getting 286 marks in the examination while qualifying marks for the promotion were 287.
2.0 No illegality or even impropriety having been canvassed or found in the impugned oder of learned Single Judge, the appeal is dismissed in limine along with Civil Application.
