Petitioners had applied for the post of Class IV employee (Sweeper) in the establishment of the Panchayat Raj Officer, Etawah in response to an advertisement of the year 2008. The petitioners appeared in the said examination and in consequence, the first petitioner secured 18.50 marks whereas the second petitioner secured 23.25 marks. On instructions being sought from the respondent, Sri J.S. Bundela, learned Standing Counsel has produced written instructions received from the District Panchayat Raj Officer, Etawah where in paragraph 3, it has been categorically averred that the cut off marks for candidates of the OBC category is 23.75 marks which are far above the marks secured by both the petitioners. The merit list has been appended to the said instructions which has been perused by the Court. There is, thus, no good ground to interfere.
The writ petition fails and is, accordingly, dismissed. There shall be no order as to costs.
The written instructions dated 17.12.2019 together with the record received from the District Panchayat Raj Officer, Etawah shall be retained on record and shall form part of it.
