Heard learned counsel for the petitioner; Shri Vivek Srivastava, learned Standing Counsel for the State respondents and Shri Manu Singh, learned counsel appearing for the Gaon Sabha.
The only grievance of the petitioner is that his appeal No.00868 of 2018 under Clause-28 (3) of Scheduled Commodities (Distribution) Order, 2004 alongwith stay application is pending before second respondent but the same has not been decided so far.
Learned Standing Counsel fairly states that in case the stay application filed alongwith the appeal is still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the second respondent to decide the stay application filed alognwith the aforesaid appeal within a period of three weeks from the date of production of a certified copy of this order before him. The aforesaid appeal may also be decided within a period of three months from today.
