Following orders were passed in the matter on 20th April, 2018:-
"Grievance is that persons who were placed at serial no.62, 64 and 65 in the seniority list have been considered for promotion but the claim of petitioner, who stands at serial no.61, has not been considered. Submission is that respondents are acting arbitrarily.
Learned Standing Counsel may obtain instructions from the concerned respondent.
Post as fresh on 27.4.2018."
Sri Vivek Rai, learned Additional Chief Standing Counsel, has obtained instructions. It is stated that petitioner's length of service was inadvertently calculated, and therefore, the list has been revised, and petitioner's name has also been forwarded for being considered for promotion.
In view of the stand taken by the respondents, this writ petition stands disposed of with a direction upon the respondents to appropriately correct the seniority list and also accord consideration to petitioner's claim for promotion, in accordance with law. The required action shall be taken within a period of three months from the date of presentation of certified copy of this order.
