Heard learned counsel for the applicant and Sri K.R. Singh, the learned Additional Chief Standing Counsel.
Pursuant to an order of the writ Court dated 9 March 2017 the Assistant Collector concerned had passed an order on 4 October 2017 indicating therein the various steps for eviction which had been initiated and concluded in respect of public utility land upon which encroachments were stated to have been made. The Court in its last order had noted that no action had been initiated in respect of Plot Nos. 410 and 411 although they stood reserved for a public utility. It was in this context that Sri Singh was asked to obtain instructions. Pursuant to the liberty granted, Sri Singh has made a statement today that after further enquiry it has been found that the constructions which were existing on Plot Nos. 410 and 411, have been raised after the conclusion of consolidation operations and that consequently statutory proceedings for eviction of all encroachers has been initiated in respect of the two plots. He further states that the proceedings so initiated shall be taken to their logical conclusion and that due proceedings for their enforcement shall be drawn up in accordance with law.
In view of the statement so made, nothing further survives on this petition, which shall stand disposed of.
