Heard Sri Rakesh Kumar Singh, learned counsel for the petitioner. Notices for the opposite parties have been accepted by the office of learned CSC.
The case set forth by the learned counsel for the petitioner is that the petitioner, who is serving on the post of Personal Assistant, Grade-2 has been transferred from the office of Additional Director Prosecution, Bareilly Region, Bareilly to the office of Joint Director Prosecution, Bhadohi. Feeling aggrieved by the aforesaid transfer order dated 13.6.2019, the petitioner preferred a representation to the Director General Prosecution, Directorate of Prosecution, U.P., Lucknow on 17.6.2019. The Additional Director (Legal), Directorate of Prosecution has issued a letter dated 27.6.2019 directing the petitioner firstly to submit his joining at the transferred place, thereafter his representation shall be considered.
Submission of learned counsel for the petitioner is that in compliance of the order dated 27.6.2019, the petitioner has submitted his joining at Bhadohi but till date, no appropriate order has been passed on the representation of the petitioner, which is contained in Annexure No.10 to the writ petition.
Therefore, without entering into merit of the issue, the writ petition is disposed of finally at the admission stage directing the Director General, Prosecution, Directorate of Prosecution, U.P., Lucknow to consider and decide the representation of the petitioner dated 17.6.2019, which is contained in Annexure No.10 to the writ petition, strictly in accordance with law and also as per the transfer policy, with expedition, preferably within a period of two weeks from the date of production of certified copy of the order of this Court and decision thereof be intimated to the petitioner forthwith.
