Heard Sri Sunil Kumar Singh, learned counsel for the petitioners, learned Standing Counsel on behalf of respondent nos.1 and 3 and Sri Ashok Kumar, learned counsel on behalf of respondent nos.2 and 4.
In terms of the order passed by this Court on 25.2.2019 instructions were placed by Mr. Ashok Kumar representing District Basic Education Officer, Banda. It is contended on behalf of respondents that in terms of the report submitted by the Block Education Officer dated 26.2.2019, it is clear that the petitioner no.2 Smt. Chhaya Devi has already been attached as Assistant Teacher in Poorve Madhyamik Vidhayalaya, Kherva, Block Mahuva. It is contended by the learned counsel for the petitioner that petitioner no.1 husband of the petitioner no.2 is also working on the post of Assistant Teacher in the aforesaid institution.
It is contended by Mr. Ashok Kumar representing District Basic Education Officer that there is no such policy issued by the State Government for transfer of the teachers working in the primary/junior schools for their transfer in the same district. The present writ petition is on the different footing.
In the peculiar facts and circumstances of the case, the District Basic Education Officer, Banda is directed to permit the petitioner no.2 to work on the post of Assistant Teacher in Poorve Madhyamik Vidhayalaya, Kherva, Block Mahuva till the time any further order is passed for the transfer of petitioners in some other institutions in the District Banda itself.
