Heard learned counsel for the applicant and learned AGA for the State.
By way of the instant application, the applicant has prayed for a direction to the court below to decide the Complaint Case No.1610 of 2018, under Section 138 N.I. Act, 1881, pending in the court of Chief Judicial Magistrate, Bulandshahar, expeditiously.
Learned counsel for the applicant submits that proceeding was initiated in the year 2018, but the same has not yet been completed.
Learned AGA has submitted that it is the bounden duty of the trial court to ensure expeditious disposal of the cases without incurring unnecessary delay and it should normally be disposed off within six months of its institution.
I have considered the submissions advanced by learned counsel for the applicant and perused the record.
In view of above but without expressing any opinion on the merits of the case, this application is finally disposed off with direction to the court concerned to decide the aforesaid case expeditiously without incurring unnecessary delay as mandated under Section 143(2)(3) of the Negotiable Instruments Act, 1881.
Accordingly, this application is disposed of.
