It is represented by both the counsel that the auction was held on 10.07.2009 and the petitioner has not become successful.
2. In view of the same, the cause does not survive for adjudication in the writ petition. But however, learned counsel for the petitioner seeks a direction for refund of the EMD amount. It is left open to the petitioner to file an appropriate application and that the respondents shall consider the same for refund of the amount, if not already refunded.
3. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
