Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondent Corporation, apart from perusing the record.
Since the issue runs in a narrow compass, the Writ Petition is disposed of at the admission stage itself.
The facts relevant to the extent of disposal of the present writ petition are that the petitioner, who belongs to BC-B community, possesses the qualification of ITI (Electrician). In response to the notification issued by the first respondent on 05.01.2011 and the supplementary notification on 17.10.2011 for filling up of 1755 Junior Plant Attendant posts in the power generating stations across the State of Andhra Pradesh, the petitioner offered himself as one of the candidates under reserved category by filing the necessary application. It is stated that the total posts in Kakatiya Thermal Power Project are 449, out of which, 225 posts have been reserved for land losers and 224 for open category. The petitioner is said to have faced written test on 18.12.2011 and got selected in 1:3 ratio. It is further brought on record that the petitioner also appeared for the trade test on 13.04.2013 and is said to have secured 70.87 marks.
It is the contention of the learned counsel for the petitioner that, later though the list of successful candidates has been published, the candidates who stood at Sl.Nos.60 and 85 were disqualified for reasons stated against their names in the said list. Incidentally, both the candidates belong to BC-B category. According to the learned counsel since two reserved posts earmarked for BC-B remained unfilled, the petitioner ought to have been considered. Accordingly, the petitioner made a representation on 26.03.2014 to consider his case in the place of either of those disqualified candidates under the said reserved category inasmuch as the petitioner stood selected already with sufficient marks. In other words, the grievance of the petitioner is that despite clear vacancies and despite the representation made by the petitioner in that regard, the authorities so far have not taken any decision concerning the appointment of the petitioner in either of the remaining vacancies.
The learned Standing Counsel for the respondent Corporation has fairly submitted that the authorities would consider the representation in accordance with law and pass appropriate orders thereon as early as possible.
Noting down the said submissions of both the learned counsel, this Court disposes of the present writ petition with a direction to the respondent authorities to consider the representation of the petitioner dated 26.03.2014 objectively and pass appropriate orders in accordance with law as expeditiously as possible, at any rate within a period of six weeks from the date of receipt of a copy of this order.
With the above observations, the writ petition stands disposed of. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any, pending in this writ petition, shall stand disposed of as infructuous.
