Challenge is made to the order of Family Court passed in HMP NO. 1532 of 2010, whereby it directed petitioner herein to undergo DNA test.
Learned advocate Mr.R.D.Dave appearing for the petitioner urged this Court that the decisions rendered in case of Goutam Kundu Vs. State of West Bengal & Anr. reported in (1993) 3 SCC 418 and in case of Bhabani Prasad Jen Vs. Convenor Secretary, Orissa State Commission for Women and Anr., reported in AIR 2010 SC 2851 are not followed either in letter or in spirit in the order impugned.
Issue notice to the respondents returnable on 2nd July, 2012. Direct service is permitted.
