RAMANJANEYULU COUNSEL FOR THE RESPONDENT: THE PUBLIC PROSECUTOR Petition under Section 439 of Cr.P.C., praying that in the circumstances stated in the memorandum of grounds filed herein, the High Court may be pleased to enlarge him on bail pertaining to S.C.No.472/2012 on the file of I Addl.Sessions Judge, Mahaboobnagar.
The Court made the following Order:
“The petitioner is A-1. He seeks for grant of bail. He allegedly committed offences under Sections 302, 201 and 379 read with Section 34 IPC. The petitioner filed a bail application before this Court about a week ago. However, he withdrew the same and filed the present application.
The learned counsel for the petitioner submitted that the father of the petitioner is seriously ill and the presence of the petitioner is required to take care of his father.
The petitioner, who is A1 in SC No. 472 of 2012 is undergoing trial in the case. It would appear that the petitioner jumped bail during trial leading to the issuance of NBWs against the petitioner. The petitioner was subsequently arrested on 21.12.2013 and has been in jail.
The petitioner thus was on bail and has been remanded to judicial custody as he jumped bail. Since about four months the petitioner has been in jail. I hope and trust that the petitioner has understood, at his cost, the efficacy of not honouring the directions of the Court. With this belief, I consider it appropriate to enlarge the petitioner on bail, as the petitioner was on bail earlier and also in view of the health condition of his father.
Accordingly, this Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs.10,000/-Rupees Ten Thousand Only) with two sureties in a likesum to the satisfaction of the learned Additional Judicial Magistrate of First Class, Shadnagar. After his release, the petitioner shall appear regularly before the SHO, Shadnagar Police Station on every day between 9.00 AM and 6.00 PM except those days when his presence is necessary for trial before the Sessions Court.”
