Prathima Honnapura, AGA) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India, praying to quash the impugned notice dated 22.07.2019 is produced as Annexure-E as the same is without authority of law and violative of the principles of natural justice etc., This Writ Petition coming on for Orders, this day, the Court made the following:-
O R D E R Ms.Vijetha R. Naik, learned counsel for the petitioner.
Smt.Prathima Honnapura, learned Additional Government Advocate for the respondents appears on advance notice.
2. Perused the petition. The petition is admitted for hearing and with the consent of the learned counsel for the parties, the same is heard finally.
3. In this petition, petitioner inter alia seeks for quashment of impugned notice dated 22.7.2019 by which the petitioner has been asked to produce documents within a period of 3 days.
4. When the matter is taken up for hearing, the learned counsel for the petitioner submitted that the petitioner has received the copy of the aforesaid notice on 23.7.2019 and the documents which are sought from the petitioner are voluminous in nature and it is not practically impossible to supply the same within a period of 3 days. He further submits that the petitioner undertakes to supply the documents before the authority which has issued notice on or before 26.8.2019, positively. The aforesaid prayer has not been clearly opposed by the learned Additional Government Advocate.
5. In view of the submission made and as agreed to by learned counsel for the parties, the Writ Petition is disposed of with a direction to the petitioner to furnish the documents as sought for by impugned notice dated 22.7.2019 on or before 26.8.2019 before the concerned authority, positively.
