This petition is filed for a Writ of Habeas Corpus to produce the brother of the petitioner from the illegal custody of his wife, the fourth respondent. The petitioner does not seem to have approached the police or lodged a complaint as to the alleged commission of an offence by the fourth respondent. Without availing the statutory remedies provided under criminal law, it is not proper for the petitioner to approach this Court directly and seek exercise of its extraordinary jurisdiction. This is therefore not a fit case for issuance of a Writ of Habeas Corpus.
The writ petition is accordingly dismissed. It is left open to the petitioner to avail appropriate statutory remedies in accordance with law. No order as to costs.
