HON’BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3635 of 2008 ORDER:
The petitioner filed the present writ petition challenging the Errata (Amendment) bearing No.61/2008-D dated 05.02.2008 issued by the respondents to fill-up the posts of Fair Price Shop dealers for the Vizianagaram Division. The notification was issued on 31.01.2008 inviting the applications to fill-up the vacancies of the fair price shop dealers. In the annexure to the said notification at Sl.No.7, the vacancy t o Govindapuram village was reserved for ‘SC’ category. But in the Errata, it was changed from the category of ‘SC’ to ‘Physically Handicapped’.
2. This Court by order dated 22.02.2008 granted interim stay. However, the stay was vacated on 13.09.2010 observing that this Court was convinced that the category was changed from Scheduled Caste to the physically handicapped in order to make good the deficiency of reservation to the physically handicapped category, as the scheduled caste candidates were holding more fair price shops than they are eligible in terms of G.O.Ms.No.53, dated 06.10.2003.
3. In view of the vacation of the interim order by a reasoned order, nothing survives in the writ petition for adjudication in view of the long lapse of time.
4. The writ petition is accordingly dismissed. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence. No order as to costs.
