Grievance of the petitioner is that though plots were not subject matter of acquisition proceeding still the land has been utilised by the National Highway Authority even without paying any compensation.
Sri Devendra Kumar, who has accepted notice on behalf of respondent no.4, on the basis of instruction states that since by mistake certain plots were left out for advertisement but acquisition of the said plot is necessary for the purpose of road widening. Vide letter dated 19.03.2018 issued by Project Director, National Highways Authority of India requested to the Sub-Divisional Officer, Tehsil Sadar, Varanasi to submit a report with regard to such plot so necessary steps may be taken to purchase the said plot by negotiation or mutual consent. A copy of order dated 19.03.2018 be taken on record.
Learned counsel for the respondent no.4 further states that as soon as the report is received immediate step should be taken for redressal of grievance of the petitioner.
In such circumstance, we dispose of the writ petition by providing that since the land of the petitioner is admitted to have been utilised for the purpose of road widening, suitable steps for purchasing the land by negotiation and mutual consent may be taken by the authority within two months from today.
