Heard Sri Vivek Sharma, learned counsel for the petitioners and Sri Abhijeet Mukherjee, learned AGA for the State.
Learned AGA pointed out that the learned counsel for the petitioners has neither annexed the statement of the victim recorded u/s 164 Cr.P.C nor annexed the medical examination report of the victim.
Learned counsel for the petitioners states that the present petition be dismissed as not pressed with liberty to file fresh petition annexing the statement of the victim recorded u/s 164 Cr.P.C and also the medical examination report.
The present writ petition is, accordingly, dismissed as not pressed with liberty to file fresh petition.
Office is directed to return the certified copy of the FIR to the learned counsel for the petitioners after retaining a photocopy of the same.
