JUDGMENT / ORDER

1. The present Civil Application has been preferred by the applicant herein
- original appellant to serve respondent Nos.4/1, 7 and 8 by way of substituted service under Order V Rule 20 of the Code of Civil Procedure by publishing the same in daily newspaper having wide circulation in Ahmedabad.
2. Mr.A.M.Parekh, learned advocate appearing on behalf of respondent Nos.5 and 6 has stated at the bar that he will be appearing on behalf of respondent No.4/1 in the main Second Appeal as well as Civil Applications therein and he shall file his Vakalatnama on behalf of respondent No.4/1 within a period of two weeks from today. Under the circumstances, no further order is required to be passed so far as respondent No.4/1 is concerned.
3. Now so far as prayer of the applicant to serve notice of admission of Second Appeal as well as Civil Applications therein, upon respondent Nos.7 & 8 is concerned, considering the fact that before learned Trial Court also respondent Nos.7 & 8 were served by substituted service by publishing the same in daily newspaper "Divya Bhaskar", the present Civil Application is allowed by permitting the applicant to serve notice of admission of Second Appeal No.169 of 2011 and connected Civil Applications by substituted service by publishing the same in daily newspapers namely "Divya Bhaskar" and "Gujarat Samachar", both in gujarati edition, for which, formal Notice is made returnable on 10/05/2012. With this, the present Civil Application is disposed of.
