Yasmin @ Chanda vs State Of U.P.

High Court Of Judicature at Allahabad|29 January, 2021

JUDGMENT / ORDER

Heard Mohd. Monis, learned counsel for the applicant, Sri Sanjay Kumar Singh, learned A.G.A. for the State and perused the material on record.
This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant-Yasmin @ Chanda seeking enlargement on bail during trial in connection with Case Crime No.348 of 2017, u/s 3/4/5 Explosive Substance Act and Section 286, 304, 308, 427 IPC, registered at Police Station Maharajpur, district Kanpur Nagar.
Learned counsel for the applicant argued that identically placed co-accused Ayaz, Amir and Shakil Ahmad @ Hero have already been granted bail by coordinate Benches of this Court vide order dated 16.6.2020, 4.3.2020 and 3.11.2020 in Criminal Misc. Bail Application Nos. 11137 of 2020, 6084 of 2018 and 17692 of 2019, copy of the said orders is annexed as Annexure No.7 to the affidavit. It is further argued that since the role of the applicant is not distinguishable from the role of said co-accused persons as such the applicant is entitled to bail on the ground of parity. It has also been pointed out that the applicant is not having any criminal history as stated in para no.28 of the affidavit and is in jail since 4.11.2020.
Per contra learned A.G.A. has opposed the prayer for bail.
After perusing the record in the light of the submissions made at the bar and after taking an overall view of all the facts and circumstances of this case, the nature of evidence, the period of detention already undergone, the unlikelihood of early conclusion of trial and also the absence of any convincing material to indicate the possibility of tampering with the evidence, this Court is of the view that the applicant may be enlarged on bail.
Let the applicant-Yasmin @ Chanda, be released on bail in the aforesaid case crime number on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:-

(iii) The applicant shall file an undertaking to the effect that she shall not seek any adjournment on the date fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law.
(iv) The applicant will not misuse the liberty of bail in any manner whatsoever. In case, the applicant misuses the liberty of bail during trial and in order to secure her presence proclamation under section 82 Cr.P.C., may be issued and if applicant fails to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against her, in accordance with law, under section 174-A I.P.C.
(v) The applicant shall remain present, in person, before the trial court on dates fixed for (1) opening of the case, (2) framing of charge and (3) recording of statement under Section 313 Cr.P.C. If in the opinion of the trial court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against her in accordance with law and the trial court may proceed against her under Section 229-A IPC.
(vi) The trial court may make all possible efforts/endeavour and try to conclude the trial expeditiously after the release of the applicant.
