JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) The present application is filed by the convict through jail seeking temporary bail for a period 90 days so as to undertake construction of residential premises on the plot, which is given to the convict in 'Garib Kalyan Mela' on 08.02.2010 at Radhanpur.
RULE.
Learned Additional Public Prosecutor Mr.L.R.Pujari waives service of Rule and invited the attention of the Court to the jail remarks.
The convict is undergoing the sentence of seven years for the offences punishable under Sections 395 and 397 of the Indian Penal Code passed in Sessions Case Nos.27 of 2009 with 77 of 2009, whereby he was convicted vide judgment and order dated 02.08.2010. As on 09.06.2012, he has undergone imprisonment of 2 years 6 months and 25 days. Recently, he has enjoyed 2 temporary bail, one in the month of April, 2012 for 10 days and another in the month of May, 2012 for 10 days on the occasion of Sunnat ceremony of his son and marriage in the family respectively. On both the occasions, he has reported in time. Nothing adverse is reported against the convict.
For the contents of the application, the same is allowed. The convict is ordered to be released on temporary bail for a period of 25 days from the date of his release on his executing a personal bond of Rs.5,000/- (Rupees five thousand only) to the satisfaction of the jail authorities.
The convict shall surrender himself to the jail authorities on expiry of the above temporary bail period. The application is allowed. Rule is made absolute.
